You may use the Platform to browse listings, research travel experiences, contact businesses, and book experiences offered by our partners. You are responsible for ensuring that all information you provide on the Platform is accurate and complete.

Definitions
Business Partner: Any entity that collaborates with us to offer travel-related services.
Customer: Any individual or entity that visits our website and/or signs up for our services.

Eligibility
By using our website, you confirm that you are at least 18 years old and legally capable of entering into binding contracts.

1.3. Business Partnerships

  • Registration and Listings: To list your business/experiences, you must register and provide accurate information. Misleading listings may result in removal from the platform.

  • Proper Licensing: You must have all required licenses, permits, and insurance to legally operate your business and offer the listed experiences in Kenya.

  • Safety and Quality: You are responsible for providing safe, high-quality experiences following industry best practices and local regulations. Proper risk assessments should be conducted.

  • Liability: JourneyPalette is not liable for any loss, injury or damages during the experiences booked through the platform. Businesses are responsible for necessary liability coverage.

  • Pricing and Payments: You set your own pricing and will receive a commission percentage as per your partnership agreement. JourneyPalette will handle payments securely.

  • Marketing Standards: Any marketing materials provided must be accurate, legal, and align with our brand guidelines on ethical and sustainable tourism promotion.

  • Data Privacy: You must comply with Kenya's data protection laws and respect customer privacy when handling personal information.

  • Code of Conduct: Discrimination based on protected characteristics is prohibited. Respectful and professional conduct towards customers is expected.

1.4. Fees and Payments

Bookings: All bookings are subject to availability, specific terms of the experience provider, and our booking policies.
Some experiences on the Platform may be subject to fees charged directly by the businesses. We may also charge a service fee for certain bookings.
Fees and Payments: You are responsible for full payment and any applicable taxes/fees at the time of booking.
All fees are clearly displayed on the listing page and during the booking process. You are responsible for paying all fees associated with your booking.
We accept various payment methods in accordance with Kenyan regulations.

1.5. Cancellations and Refunds

Cancellation and refund policies vary per experience. Applicable fees may apply for cancellations as per the experience terms
Cancellation policies are determined by the individual businesses offering the experiences. We recommend carefully reviewing the cancellation policy before booking.
In case of cancellation by the business, we will work with you to find a suitable alternative experience or facilitate a full refund.
JourneyPalette is not responsible for any cancellation fees or changes imposed by the business.

1.6. Disclaimer

Liability: JourneyPalette facilitates bookings only. Liability for experiences rests solely with the experience providers.
JourneyPalette does not own or operate any of the travel experiences offered on our Platform. We do not guarantee the quality, safety, or accuracy of any experience offered by our partners.

1.7. User Conduct

Travel Documentation: You are solely responsible for having proper travel documentation like visas or insurance as required for your experiences.
Code of Conduct: Professional, responsible, and respectful conduct is expected. We reserve the right to deny service for behavior violating our Code of Conduct.
You agree to use the Platform in a lawful and responsible manner. You will not:

  • Use the Platform for any illegal or unauthorized purpose.

  • Infringe upon the intellectual property rights of others.

  • Transmit any harmful or malicious content.

  • Interfere with the operation of the Platform.

  • Impersonate any person or entity

1.8. Limitation of Liability

JourneyPalette is not liable for any damages arising from your use of the Platform or any travel experience booked through the Platform.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.
